RESIDENTIAL TERMS OF SERVICE

1. Scope of Services
Nathan Creek Landscape will provide landscape maintenance services for your residential property, as outlined in your custom service plan or estimate. This includes all necessary labour, materials, tools, and equipment.
2. Maintenance Standards
Work will follow the “Moderate” maintenance level, as defined in Table 14-17 of the BC Landscape Standards (7th Edition). Services do not include:

Trees/shrubs over 5 meters tall

Snow removal

Irrigation maintenance or repair unless specifically included in writing
3. Contract Renewal and Pricing
Your agreement renews automatically each year on the signing anniversary. A minimum 5% price increase will apply. Any further rate changes will be communicated in writing.
4. Cancelling Service
To cancel, you must give us written notice (email or letter) at least 30 days in advance. Services will end 30 days after we receive notice.
5. Payment Terms
Payment is due within 7 days of invoice. Late payments will incur 1.5% interest monthly (18% annually).
6. Liability Limitations
We are not responsible for:

Pre-existing property issues

Weather-related service delays

Damage caused by pets, wildlife, vandalism, or other external factors
7. Changes to Service
Any changes to your service must be agreed upon in writing. Pricing and scheduling may be affected.
8. Insurance
We carry liability insurance. Proof available upon request.
9. Disputes
If a disagreement arises, both parties agree to first attempt resolution through mediation. If that fails, binding arbitration will be used under BC law.
10. Non-Renewal Notice
If you do not wish to continue services the following year, written notice must be given at least 30 days before your contract’s renewal date.
11. Intellectual Property
All designs, plans, and service methods used or created by Nathan Creek Landscape remain our property and may not be reused or shared without our written consent.
12. No Warranty
We do not offer any warranties—express or implied—beyond what is specifically agreed to in your service contract.
13. Automatic Renewal
This contract renews automatically each year on the original signing date unless you cancel as described in Section 4.
14. Force Majeure
We are not liable for delays or failure to perform due to extreme events beyond our control (e.g., severe weather, natural disasters, pandemics, etc.).
15. Suspension of Service
We may pause service if payment is not received or terms are violated. Services resume once the issue is resolved.
16. Governing Law
These terms follow the laws of British Columbia, Canada.
